지난 2011년 자신 앞에서 줄담배를 피운 남성을 성폭력 혐의로 고발한 ‘서울대 담배녀’이 계기가 돼 서울대 사회과학대 성폭력 회칙이 11년만에 개정됐다.서울대 담배녀 사건으로 인해 개정된 회칙의 가장 큰 변화는 성폭력의 범위를 축소한 것이다.‘성적이거나 성차에 기반을 둔 행위’라고 규정한 기존 회칙이 지나치게 모호하다는 지적에 따라 ‘상대의 동의를 받지 않은 성적 언동을 함으로써 (중략) 인간의 존엄을 해치는 행위’로 성폭력의 개념을 구체화했다. 담배를 피우는 것까지 성폭력으로 규정하는 건 지나치다는 학내 여론을 수렴한 결과다.서울대 사회과학대 학생회는 지난달 27일 발표한 ‘서울대학교 사회과학대학 학생회 반성폭력학생회칙’ 개정안을 통해 성폭력 범위를 종전보다 명확화•구체화했고 피해자 중심주의를 사실상 폐기했다. 개정안에는 종전 ‘한 인간의 성적 자율권을 침해하는 것, 성적이거나 성차에 기반을 둔 행위, 의도에 무관하게 피해자의 자율성이 침해되는 결과가 발생했을 경우를 모두 포함’
