대형마트, 자정~오전10시 영업제한…"최악 피했다"

대형마트의 영업제한 시간이 자정에서 다음날 오전 10시까지로 확정됐다.

국회는 1일 본회의에서 여야가 합의한 개정 유통산업발전법 절충안을 올해 예산 안과 함께 통과시켰다.

개정 유통법에 규정된 대형마트 영업제한 시간은 당초 지난달 국회 지식경제위원회에서 마련된 오후 10시~오전 10시보다 2시간 단축된 것으로 맞벌이 부부들의 야 간쇼핑 편의가 감안됐다.

'월 3일 이내'로 돼있던 의무휴업은 '일요일을 포함한 공휴일에 월 2회' 의무휴업을 하는 것으로 강화됐다.

대형 유통업체들은 이날 국회 본회의에서 우여곡절 끝에 여야의 유통산업발전법 절충안이 통과된 데 대해 "그나마 다행"이라며 "최악의 상황은 피했다"는 반응을 보였다.

공휴일을 포함한 월 2회 의무휴업이 명시된데다 영업시간 규제도 늘어난 만큼 손실이 불가피하지만 애초 개정안보다는 합의 과정에서 강도가 다소 약해진 만큼 받아들일 만하다는 분위기가 지배적이다.

대형 유통업체들은 대중소 유통업체들의 모임인 유통산업발전협의회에서 마련한 상생안에 따라 월 2회 자율휴업을 이미 시행하고 있다. 월 3회 의무휴업을 못박았던 기존안에 비춰봐도 유통업체로서는 이번 합의가 '불행중 다행'인 셈이다.

게다가 휴일 의무휴업도 이해당사자간 합의가 있으면 조정이 가능하다는 별도의 단서조항을 둔 만큼 추후 협의 과정에서 매장별 상황을 반영할 수 있을 것이라는 게 업계의 희망이다.

한 관계자는 "우여곡절이 많았지만 업계 입장에서도 크게 무리가 없는 선에서 절충안이 마련된 것 같다"며 "일요일이 들어가긴 했지만 기존에 자율휴무를 월 2회 하고 있기 때문에 큰 문제는 없을 것"이라고 평가했다.

다른 관계자도 "민주당이 주장했던 원안과 비교하면 상당히 후퇴한 것이고 대형 마트 입장도 많이 반영됐다"며 "상생협의회에서 앞으로 논의를 병행할 것인 만큼 앞으로 논의 과정이 더 중요할 것"이라고 전망했다.

다만 일각에서는 휴일을 포함해 월 2회 의무 휴업을 하면 기존 매출의 10% 정도 는 감소가 불가피하다는 우려도 나오고 있다.

유통업계의 한 고위 관계자는 "오늘 개정안이 처리되면 이마트는 15개, 롯데마트는 10개 정도 갑자기 폐점했다고 보면 된다"며 "다소 완화됐다고는 하지만 사실상 월 2회 공휴일 의무휴업을 강제했고 조정도 어렵기 때문에 분위기가 좋지만은 않다"고 전했다.

개정안이 통과되더라도 국무회의를 거쳐야 하고 이후 지자체마다 조례에 해당 내용이 반영되기 때문에 실제 법이 효력을 발휘하기까지는 5~6개월 정도 시간이 더 걸릴 전망이다.

업계 관계자는 "지난해 12월 처음 유통법이 만들어질 때도 지자체별로 처음 시행된 게 5월이었다"고 설명했다.

이 관계자는 "이 기간에 유통산업발전협의회와 논의를 거쳐 융통성있게 조례가 만들어질 수 있기를 기대한다"고 덧붙였다.

중소기업계는 유통산업발전법 개정안 통과에 환영 입장을 밝혔다.

중소기업중앙회는 논평을 통해 "이번 개정이 당초 안보다 영업시간 제한이 다소 축소돼 아쉬운 점은 있으나 대형유통과 소상공인이 상생하기 위한 양보와 타협의 과정으로 생각한다"며 "개정된 유통산업발전법이 소상공인의 생활과 경영환경 개선에 도움이 되기를 기대한다"고 강조했다. (연합뉴스)

Mom-and-pop shop protection bill passed

A revised bill to put limits on operations of large-scaled supermarkets passed the plenary session of the National Assembly on Tuesday.

Under the ruling named the Retail Industry Development Act, aimed at protecting mom and pop shops, chains of large-scaled supermarkets, including E-Mart, Lotte Mart and Homeplus, have to stop their operations between midnight and 10 a.m. for the next day.

The ruling also forces supermarket chains to close their shops two days of a month, including a Sunday. It is the first bill to limit operations of supermarket chains in Korea.

The conflict between large-scaled supermarkets, mostly owned by retail giants, and small shops on the streets or traditional markets had been escalated last year amid worsening polarization between the two parties. The issue turned into a political issue ahead of the presidential campaign on Dec. 19. The top two candidates pledged to put a grip on large-scaled supermarket chains to save small shops.

The passed retail bill relieved retail giants as it is eased in terms of operating hours compared with the proposal by the main opposition Democratic United Party. DUP’ bill proposed chains of super-markets to close from 10.00 p.m. to 6.a.m. the next day. From 10 p.m. to midnight is one of peak times for grocery shoppers at night.

But the bill puts a tighter rule on days for monthly operations of supermarket chains. The DUP proposal forces retailers to close their supermarket chains up to three days a month, while the passed bill rules two days off, including a Sunday.

Representatives from small shops were not reachable on a national holiday.

It takes five or six months to see the bill as the bill has to go through a couple of additional processes, including coordination with rules of local city governments.

Industry watchers remain positive about the launch of the bill as the new government seeking an economic democratization will not overlook the continued conflicts between the large-scaled retailers and small mon and pop shops.
