A medical doctor was sentenced to 20 years in prison in a retrial on Friday for murdering his pregnant wife.

The 32-year-old doctor surnamed Baek initially received the same jail sentence by a district court and an appeals court for strangling his nine-month pregnant wife to death during an early-morning quarrel early last year.

The Supreme Court, however, overturned an appeals court's conviction and sent the case back to the Seoul High Court for reconsideration, citing a lack of objective evidence backing the conviction.

"The court accepts charges (raised by the prosecution) that Baek accidentally murdered the victim after an argument," Judge Yoon Seok-won of the Seoul High Court said in a ruling, upholding the earlier rulings.

The quarrel took place when the 29-year-old wife complained about Baek's heavy online gaming habit, according to court documents. Baek, who was under severe stress at the time due to a state medical doctor qualification test he took a day earlier, accidentally committed the murder, the documents showed.

The doctor, however, has claimed that he had reported his wife's death to the police himself, saying he found her lying dead over a bathtub in the couple's apartment after he returned home in the evening.

Citing his medical career and knowledge, Baek claimed his wife might have slipped in the bathroom and the extra weight from the pregnancy could have led to her suffocation.

Judge Yoon, however, declined the defendant's argument, citing various pieces of forensic evidence such as marks around her neck, bruises around her right side of the jawbone and internal bleeding.

The rare murder case by a doctor drew heavy media attention and required a batch of forensic specialists to prove Baek's responsibility.

The Supreme Court would again arraign the case if Baek appeals, according to court officials. (Yonhap News)

만삭인 아내를 살해한 혐의로 기소돼 1•2심에 서 징역형을 선고받았던 의사 백모(32)씨에 대한 파기환송심에서 법원이 유죄를 선고했다.

서울고법 형사7부(윤성원 부장판사)는 7일 살인 혐의로 기소된 의사 백모(32)씨에 대한 파기환송심 선고공판에서 백씨와 검찰의 항소를 모두 기각하고 원심과 같은 징역 20년을 선고했다.

재판부는 우선 "목 부위 피부 까짐, 오른쪽 턱뼈 주변의 멍, 근육 내 출혈, 정수리와 얼굴의 상처 등에 비춰보면 피해자는 백씨의 주장처럼 이상자세로 인해 질식사한 것이 아니라 목을 눌려 사망한 것으로 판단된다"고 밝혔다.

백씨는 아내의 사망이 `목 눌림에 의한 질식사'가 아닌 만삭 임신부의 신체적 특성 때문이었다며 결백을 주장해왔다.

재판부는 "피해자의 상처와 백씨 옷에서 발견된 혈흔이 둘이 다툰 흔적으로 판단되는 점, 백씨가 사건 당일 전화를 잘 받지 않는 등 의문스러운 행동을 보인 점, 제3자의 범행 가능성이 희박한 점을 고려하면 백씨가 피해자와 말다툼•몸싸움을 하 다가 우발적으로 목을 졸라 살해했다는 공소사실이 유죄로 인정된다"고 판시했다.

재판부는 피해자 사망 시각에 대해서는 시신강직•시반형성에 기초한 추정시각과 당시 출근준비가 되지 않았던 피해자의 모습 등 정황을 고려하면 백씨가 집을 나 선 오전 6시41분 이전에 이미 숨졌을 가능성이 크다고 판단했다.

또 부부가 전문의 자격시험과 아이 출산으로 예민한 상황이었던 점, 백씨가 시험에 불합격할 수 있다는 불안감에 심한 충격을 받았을 것으로 보이는 점, 피해자가 백씨의 게임중독 증세를 우려하는 말을 자주한 점을 고려하면 우발적•충동적으로 목을 조르는 상황에 이르게 될 동기도 충분하다고 봤다.

재판부는 다만 "백씨에게 자신의 아이를 임신한 아내를 계획적으로 살해할 동기가 있었다고 보기는 어렵다"고 덧붙였다.

재판부는 원심의 형이 가볍다는 검찰 주장은 "피고인만이 상고해 대법원에서 판 결이 파기된 경우 불이익 변경금지 원칙에 따라 원심보다 더 무거운 형을 선고할 수 는 없다"며 받아들이지 않았다.

백씨는 작년 1월 서울 마포구 도화동 자신의 집에서 만삭인 아내 박모(당시 29세)씨와 다투다가 목을 졸라 숨지게 한 혐의(살인)로 기소돼 1, 2심에서 징역 20년을 선고받았다.

그러나 지난 6월 대법원은 "사망원인 등을 치밀하게 다시 검증할 필요가 있다"며 사건을 서울고법으로 돌려보냈다.

피해자 유족은 재판이 끝난 뒤 "사법부와 검찰이 사건의 가려진 진실을 밝혀줘 서 진심으로 감사하다"고 말했다.

백씨가 상고하면 이 사건은 대법원에서 다시 심리하게 된다.
