A 58-year-old man was sentenced to 25 years behind bars for raping his underage niece as well as impregnating her, a Suwon court said Wednesday, amid growing calls for tougher punishments for brutal sex crimes against minors.

The Suwon District Court handed down the hefty prison term to the man, only identified by his surname Cheong, convicted of raping his niece on multiple occasions between September 2005 and July this year in his house in Pyongtaek, south of Seoul. 

The niece, who is now 16 years old, also gave birth as a result.

In addition to the prison term, the court also ordered that he complete 120 hours in a rehabilitation program and that his personal information be made available to the public for 10 years.

"The defendant failed his obligations to protect and take care of the victim, and instead committed a heinous crime against humanity just to fulfill his sexual desire," the court said in a ruling. "A long prison term is necessary in order to isolate the defendant from society for a substantial period of time."

The ruling is the latest in a series of unnerving sex crimes in South Korea that have targeted underage youths, including very young children under the age of 13.

The government is currently looking to revise the law to increase the penalty for sex offenses against minors and make it possible to punish sex offenders without the victims having to file a complaint. (Yonhap News)

친조카 7년간 성폭행한 '인간말종' 결국...


수원지법 평택지원 형사합의부(김진현 부장판사 )는 14일 친조카를 7년여동안 상습 성폭행, 출산까지 시킨 혐의(친족관계에 의한 강간 등)로 기소된 정모(58)씨에 대해 징역 25년을 선고했다.

또 정보공개 10년과 120시간의 성폭력치료 프로그램 이수를 명했다.

재판부는 판결문에서 "피해자를 건전하게 양육하고 보호해야 할 의무를 저버린 채 자신의 성욕구를 채우기 위해 저지른 반인륜적인 친족간 범죄로 죄질이 극히 불량하다"며 "피고인을 사회에서 상당한 기간 격리시킬 필요가 있어 장기간의 실형을 선고하다"고 판시했다.

재판부는 "피해자가 16세 아동으로서 쉽게 감내하기 어려운 정도의 극심한 정신적 고통을 받고 있고, 법정 대리인인 아버지가 피고인의 처벌을 원하고 있어 기본범죄에 경합범죄를 추가해 양형기준을 산출했다"고 밝혔다.

정씨는 함께 살던 친조카가 초등학교 3학년이던 2005년 9월부터 지난 7월까지 7년여동안 상습적인 성폭행을 해 출산까지 시킨 혐의로 구속기소됐다.

13세 미만 성범죄의 다수범죄 처리기준에 따라 수정된 권고형의 범위는 징역 11 년∼41년3월이다.

검찰은 최근 구형공판에서 "성범죄는 정신적인 살인행위로 초등학생 때부터 고등학생까지 7년여 동안 지속적인 추행과 강간을 일삼은 큰아버지의 죄질이 매우 불량하다"며 '친족관계에 의한 강간' 혐의를 적용하고 범죄가 계속 이어진 점을 감안해 경합범(가장 중한죄 형량의 2분의1 가중)으로 45년을 구형했었다.
