Nov. 21 (Bloomberg) -- Philip Morris International Inc. served an arbitration notice against the Australian government to claim 'millions of dollars' in damages after the nation passed the world's first plain-packaging law for cigarettes.
The passage of the law today violates Australia's Bilateral Investment Treaty with Hong Kong, Philip Morris Asia Ltd., manager of the tobacco company's Asian business, said in an e- mailed statement.
The legislation requires all cigarettes sold in Australia to be in plain packaging from Dec. 1, 2012.
Philip Morris, the world's largest publicly traded tobacco company, also said today it intends to file a suit against the government in the High Court of Australia. British American Tobacco Plc, Europe's biggest cigarette maker, said Nov. 10 it is unconstitutional to remove a legal company's property without compensation, and it planned to sue in Australia's top court.
"We are left with no option," Anne Edwards, a spokeswoman at Hong Kong-based Philip Morris Asia, said in the statement.
The company said it expects damages to amount to billions of dollars and that the legal process will take two to three years. Philip Morris proposed that the arbitration procedure take place in Singapore.
Under the new Australian law, cigarettes will have to be sold in dark brown packages, with no company logos and the same font for all brands.
"Big tobacco has made it a habit to challenge Australian government tobacco controls over the decade," Health Minister Nicola Roxon said in a statement earlier today.
"Today I ask them to break their habit, act in the best interest of the health and wellbeing of the Australian people and accept the determination of the people's parliament," she said.

필립모리스, 호주정부 금연정책에 법적대응
거대 담배 회사인 필립모리스가 21일 세계 최초로 모든 제품에 똑같은 글꼴을 사용하는 밋밋한 담뱃갑 포장을 의무화한 호주 정부를 상대로 법적 대응에 나섰다.
홍콩에 있는 필립모리스아시아(PMA)는 호주 정부가 호주와 홍콩의 양자투자협정을 위반했다면서 중재 통지서를 전달했다고 밝혔다.
세계 최대의 담배 회사인 필립모리스는 호주의 새 법안 때문에 수십억 달러의 손해를 볼 것으로 예상한다면서 호주 정부를 상대로 호주 고등법원에 소송을 낼 계획도 있다고 말했다.
이 회사의 앤 에드워즈 대변인은 성명에서 "우리에겐 선택의 여지가 없다"고 말했다.
브리티시아메리칸토바코(BAT)도 지난 10일 호주 정부를 제소할 계획이라고 밝힌바 있다.
내년 12월부터 시행되는 호주 정부의 새 법안은 담뱃갑 포장지가 갈색에다 회사로고가 없고 모든 제품이 똑같은 글꼴을 사용하도록 규정하고 있다.
호주에서는 이미 담배 광고와 공공건물 내 흡연, 매장 내 담배 진열 등이 금지돼 있다.
업계 분석가들은 밋밋한 담뱃갑 포장이 브라질과 러시아, 인도네시아 같은 새로떠오르는 중요한 시장으로 확산해 매출 성장세가 꺾일까 봐 걱정하고 있다.
반면 비슷한 법안을 검토하는 유럽과 캐나다, 뉴질랜드의 정부들은 호주를 예의주시하는 상황이다.
법률 전문가들은 지적재산권 협정에 따라 개별 정부는 국민 건강을 위한 법안을 만들 권리가 있다면서 법원이나 세계무역기구(WTO)를 통해 호주 정부의 새 금연정책을 저지하려는 담배 회사의 시도는 실패할 것으로 예측했다.
