Samsung vows legal action over Apple's patent-infringement claim

Samsung Electronics Co. said Tuesday that it will seek legal action against Apple Inc. over the U.S. company's accusation that the maker of the Galaxy S smartphone infringed upon Apple's patents.

Samsung's response comes on the heels of Apple's allegation in a complaint with a U.S. court that the Galaxy S phone and the Galaxy Tab tablet computers copied design, mobile software and other patents of the iPhone and the iPad.

"We think Apple has violated our patents in communications standards," Chung Jae-woong, a spokesman at Samsung Electronics, said by phone. "We are considering a counterclaim."

He declined to further elaborate on what Apple products allegedly violated Samsung's wireless technology patents, but the company will proceed with a lawsuit after a careful review.

"Though Apple is our client, it is also our rival in the mobile market," he added. "Since (Apple) sued us, taking a legal action is inevitable."

Apple was Samsung's second-largest client in 2010 after Sony Corp. Four percent of the Korean company's 155 trillion won ($142 billion) annual revenues was generated from Apple last year, mostly by supplying semiconductors and display panels.

Apple filed a lawsuit with a U.S. court on Monday, according to the representative of the company in Korea. The company sought a court order to block the use of its patents in Samsung's mobile devices and cash compensations among others.

"It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging," Apple spokesman Steve Park said in a statement. "This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas."

Samsung Electronics is scheduled to release the Galaxy S2 smartphone, its latest generation in the Galaxy S smartphone series, in the domestic market next week.

애플, 삼성전자 상대 특허침해 소송

미국 애플사가 라이벌인 삼성전자의 갤럭시 스마트폰과 갤럭시탭이 자사 제품을 모방했다며 미국 현지 법원에 소송을 제기 했다고 월스트리트저널(WSJ)과 신화통신 등이 19일 보도했다.

지난 15일 캘리포니아 북부 지방법원에 제출된 소장에 따르면 애플이 이번 소송에서 실질적으로 집중하는 부분은 스크린 상의 아이콘 모양 등 갤럭시폰과 갤럭시탭 의 디자인이다.

이번 소송에서 애플은 삼성전자가 자사의 특허권과 상표권을 침해하고 있다고 주장하고 있다.

애플은 삼성전자가 앞서 출시한 스마트폰들의 경우 자사 제품들과 유사한 디자인을 갖고 있지 않았다고 지적했다.

소장에서 애플은 "삼성의 이전 스마트폰 버전의 아이콘들은 다양한 모양을 갖고 있었기 때문에 (애플 아이폰과) 달랐고 모서리를 둥글린 사각형 모양의 아이콘들이 아니었다"고 주장했다.

애플은 삼성이 자사 제품을 모방한 예로 연두색 네모 안에 수화기 모양이 그려진 통화 아이콘이나 사진보관함을 나타내는 아이콘의 해바라기 그림 등을 들었다.

애플 측 대변인은 "삼성의 신제품들이 하드웨어의 모양에서부터 사용자 환경(UI ), 심지어 포장에 이르기까지 아이폰, 아이패드와 유사한 것은 결코 우연이 아니다"라고 주장했다.

그는 "이런 노골적인 모방은 잘못된 것이고 다른 업체들이 우리 아이디어를 훔칠 경우 우리는 애플의 지적재산권을 보호할 필요가 있다"고 강조했다.

이번에 애플은 삼성전자를 상대로 부당이득, 상표권 침해와 10건에 이르는 특허 권 침해 등 모두 16건의 침해 사례에 대해 소송을 제기했다.

이에 대해 삼성전자 측은 "애플이 우리 반도체, 디스플레이 등 중요한 사업 거래처이긴 하지만 이번 소송에는 단호히 대응할 것"이라는 입장을 밝혔다.

삼성전자 관계자는 "사업경쟁력 강화를 위해 핵심 기술을 개발하고 주요 특허를 확보하고자 노력했다"며 "애플이 운영체제(OS)와 사용자 환경에 강점을 보인다면 통신표준 영역은 우리 특허가 더 많아 오히려 애플이 우리 특허를 침해한 사례가 많을 것으로 판단한다"고 말했다.

삼성 측은 맞소송을 제기하기로 사실상 방침을 정하고 구체적인 일정을 조율하고 있는 것으로 전해졌다.

이번 소송과 관련해 업계에서는 다음주께 갤럭시S2 출시를 앞두고 애플이 최대 라이벌인 삼성전자를 견제하려는 의도가 깔려있다는 분석도 나오고 있다.

영국의 시장조사업체 CCS인사이트의 존 잭슨 애널리스트도 전세계 태블릿 PC시장에서 현재 삼성이 실질적으로 애플의 유일한 경쟁상대라고 말했다.

애플은 특허권 침해 문제와 관련해 이번 소송 이외에 노키아, HTC 등과도 소송을 진행 중이다.
