KT to start long-awaited LTE service from next week

KT Corp, the nation’s second-largest telecom operator, plans to start its long-awaited Long Term Evolution service from next week after a Seoul court gave it the green light on Monday to ditch its feature phone service.

According to KT, it will shut down the second-generation network service in phases, first in Seoul at 10 a.m. on Jan. 3, starting faster LTE service straight away on that day.

The Seoul High Court on Monday overturned a lower court ruling that favored some 900 users who filed a lawsuit last month against the Korea Communications Commission to nullify its approval of KT’s 2G service shutdown.

KT has persuaded customers to switch to 3G or change their service carriers as it plans to start the faster LTE service in the 1.8 GHz band that it has been using for 2G services.

Some 2G users resisted, fiercely taking legal action early this month. And the Seoul Administrative Court admitted “Irreversible damages are expected on the remaining 2G users.” KT and the state-run telecommunications regulator appealed immediately.

“The damages caused as they are not offered the 2G service can be compensated by exercising their rights for compensation claim, while those from switching their phone numbers are due to the prefix unification policy to 010,” said the Monday ruling.

The court also found no problem in KT’s notification process for its 2G service halt and emphasized the welfare of the majority of mobile service users.

“We need to consider the efficient use of frequency band. There are only 100,000 users for KT’s 20 MHz band, while LG Uplus has 9 million users,” the court said.

The court also raised antitrust concerns, saying “If KT’s entry into the 4G service is delayed further, SK Telecom and LG Uplus are likely to enjoy excessive market dominance.”

SK Telecom and LG Uplus, the No. 1 and 3 network provider, have started the faster LTE service in July, with the number of the nation’s LTE users surpassing the 1 million mark recently.

법원, KT 2G망 폐쇄 허용

KT가 2G(2세대) 이동통신(PCS) 서비스를 즉시 폐지할 수 있게 됐다.

서울고법 행정7부(곽종훈 부장판사)와 행정4부(성백현 부장판사)는 26일 KT 2G 가입자 900여명이 2G 서비스 폐지를 승인한 방송통신위원회의 결정에 대해 제기한 집행정지 신청 항고심에서 집행정지를 받아들인 1심을 깨고 신청을 기각했다.

재판부는 "2G 서비스를 계속 제공받지 못해 생기는 손해는 손해배상 청구권 행 사로 보상될 수 있고, 기존 휴대전화 번호를 계속 유지할 수 없어 생기는 손해는 01 0 번호통합정책에 따른 것으로 2G 사업 폐지 승인으로 발생하는 직접적 불이익이라 볼 수 없다"고 밝혔다.

또 "앞서 KT가 7월25일 2G 사업 폐지를 신청하면서 9월30일을 폐지 예정일로 사 용자들에게 알렸으므로, 유예기간을 더 연장한 12월8일을 폐지예정일로 알리지 않았 다고 해서 위법하다고 보기 어렵다"고 덧붙였다.

이어 "KT의 20㎒ 주파수 대역 2G망 이용자는 10여만명에 불과한데 LG유플러스(U

+)의 같은 주파수 대역 2G망 이용자는 900만명으로 주파수의 효율적 이용을 고려해

야 한다"며 "4G망 부분에 KT의 시장진입이 늦어질 경우 SKT와 LG유플러스(U+)의 과 점구조를 고착화해 소비자 후생을 해칠 우려가 있다"고 덧붙였다.

다만 행정4부는 "갑작스런 서비스 폐지로 긴급전화를 사용할 수 없어 일부 이용 자에게 회복하기 어려운 손해가 발생할 수 있다"고 인정했으나 2G망 폐지에 따른 공 공복리가 더 중요하다고 판단했다.

KT는 지난 3월 2G 서비스 종료 방침을 정한 뒤 4월에 방통위에 폐지승인 신청을 했으나 2G 가입자 수가 많다는 이유로 승인이 유보됐다.

KT는 폐지예정일을 9월30일로 늦춰 7월에 다시 신청했고, 방통위는 지난달 23일 폐지예정일 부분을 제외한 신청을 받아들여 12월8일부터 2G망 철거를 할 수 있도록 승인했다.

이에 2G 가입자 900여명은 "KT가 가입자를 인위적으로 줄이기 위해 불법을 저질 렀음에도 폐지를 승인한 것은 위법을 묵인한 것"이라며 폐지승인 취소소송과 집행정 지 신청을 법원에 냈으며, 1심은 지난 7일 집행정지 신청을 받아들여 KT의 서비스 중단 계획에 제동을 걸었다.
