The Supreme Court has confirmed a three-year prison term for a member of LG Group family convicted of stock manipulation and embezzlement, court officials said Monday.

Koo Bon-hyun was convicted of pocketing around 13.9 billion won

(US$11.7 million) of illegal profits by manipulating the stock price of Exa E&C Inc., through spreading false information about the company during the process of taking over a new materials company in 2007. At that time, he was serving as a chief executive of EXA E&C, an electronic components and environmental company not affiliated with LG Group.

The 45-year-old Koo, a nephew of LG honorary chairman Koo Cha-kyung, is also convicted of embezzling around 76.5 billion won of company funds through accounting fraud.

A district court previously handed down a four-year prison term for Koo, but an appellate court in March reduced the sentence to three years. (Yonhap News)

회삿돈 빼돌린 재벌 3세, 결국...

대법원 2부(주심 김용덕 대법관)는 주가를 조작해 부당이득을 챙기고 회삿돈 수백억원을 빼돌린 혐의(증권거래법 위반•특정경제범죄 가중처벌법상 횡령 등)로 기소된 범 LG가(家) 3세 구본현(44) 전 엑사이엔씨 대표에 게 징역 3년을 선고한 원심을 확정했다고 9일 밝혔다.

재판부는 "유가증권신고서에 허위사실을 기재하고 부당한 이득을 얻고자 기업 홍보자료를 통해 허위사실을 유포한 사실이 인정된다고 본 원심 판결은 정당하다"고 밝혔다.

구자경 LG그룹 명예회장의 조카인 구씨는 엑사이엔씨 대표로 있던 2007년 신소 재 전문기업을 인수하는 과정에서 허위사실을 퍼뜨리는 수법으로 주가를 조작해 139억원의 부당이득을 챙기고 지인들에게 114억원의 이득을 보게 한 혐의등으로  구속 기소됐다.

또 직원 명의로 대출금을 끌어다 쓰는 것처럼 속여 765억원의 회삿돈을 횡령하고, 범행을 숨기려고 송금증을 위조하는 등 회계서류를 조작해 외부 감사인에게 제출한 혐의도 받았다.

1심은 공소사실을 대부분 유죄로 인정해 징역 4년을 선고했으나, 2심은 일부 혐의를 무죄로 봐 징역 3년으로 감형했다.
