A group of lawmakers are moving to force the government to immediately ban any beef imports from countries with a confirmed mad cow disease case, which the government said Tuesday might contradict with international regulations and the country's trade agreements.

The move was proposed on May 30 by Rep. Kim Yung-rok of the main opposition Democratic United Party in a revision to the law on animal disease. The revision bill was referred to the National Assembly Food, Agriculture, Forestry and Fisheries Committee last Monday.

The envisioned revision follows the latest case of bovine spongiform encephalopathy (BSE) or mad cow disease that was reported by the United States in April. Seoul did not ban U.S. beef imports then, but only intensified its inspection of shipments to see if they included any specific risk materials.

"The government had promised in June 2008 to immediately ban beef imports following an outbreak of mad cow disease (in any country). But it did not ban imports when the United States confirmed its fourth mad cow disease case earlier this year," Rep.

Kim said of reasons for his bill.

The revision, if legislated, will force the government to immediately place an import ban on beef from any country with a confirmed case of BSE.

The government says such a move may very well lead to trade conflicts as it contradicts with World Trade Organization regulations, as well as the country's own trade agreements, including the one with the United States, which states the country may ban imports only when there are serious and immediate threats to public health.

"Forcing the government to ban imports even when there is no immediate threat to the public health might lead to trade disputes and a likely loss if there is a formal suit," an official from the Ministry of Food, Agriculture, Forestry and Fisheries said.

The revision bill was co-sponsored by 126 other lawmakers, but whether it will be voted into law still remains to be seen due to apparent opposition from the ruling Saenuri Party, which controls

149 seats in the 300-seat unicameral parliament.

"It is difficult for the ruling party to consider a move that might contradict with WTO regulations," said Rep. Hong Moon-pyo, who also sits on the parliamentary food and agriculture committee. (Yonhap News)

미국 등 쇠고기 수출국에서 소해면상뇌증(BSE• 일명 광우병)이 추가 발생하는 즉시 국내 수입을 중단토록 한 법안이 국회 논의를 앞두고 있다.

농림수산식품부가 국내외 법과의 상충, 행정부 권한 침해 가능성 등을 우려해 법 률개정안에 강하게 반발하는데다 여당 일부에서도 부정적 의견이 나오고 있어 논란이 일 것으로 보인다.

◇`BSE 발생시 즉각 수입 중단' 조항 논란

17일 국회와 농식품부에 따르면 국회 농림수산식품위원회 통합민주당 간사인 김영록 의원이 국회의원 126명의 찬성을 얻어 발의한 `가축전염병예방법 일부 개정법 률안'이 오는 27일 상임위 전체회의에서 논의될 예정이다.

개정법률안의 주요 골자는 쇠고기 수출국에서 BSE가 추가로 발생하면 쇠고기나 쇠고기 제품을 즉시 수입중단하고 공동 검역단을 구성해 BSE 발생 국가에 파견, 현지 조사를 하도록 한 것이다.

김 의원은 2008년 6월 BSE 발생 시 즉각적인 수입 중단 조치를 약속했던 정부가 지난 4월 미국의 4번째 BSE 발생에도 수입중단 조처를 하지 않았기 때문에 개정안을 냈다고 설명했다.

그러나 농식품부는 개정법률안이 BSE의 추가 발생 시 위험 정도를 판단해 즉각 수입 중단할 수 있도록 한 현행 가축전염병예방법이나 미국산 쇠고기 수입위생조건 고시와 상충할 수 있다고 지적했다.

과학적 근거나 국제기준에 따른 판단 없이 무조건 수입을 제한하면 행정부의 정 책적 판단을 제약할 수 있는 점도 우려했다.

농식품부 한 관계자는 "개정법률안은 국내법과 같은 효력을 갖는 국제법인 세계무역기구(WTO) 동식물 검역ㆍ검사(SPS) 협정과 상충한다"며 "국민의 건강과 안전에 위험이 없는데 즉시 수입을 중단토록 한 것은 통상 마찰의 소지가 크고 분쟁 제소 때 패소할 소지가 높다"고 말했다.

농식품부의 BSE 긴급행동지침에서는 국내에서 BSE가 발생할 때 국내산 쇠고기의 유통, 판매를 금지하도록 하지는 않고 있어 수입산 쇠고기에 대해서만 차별적인 조처를 할 경우 WTO SPS 협정에 위반될 수 있다는 설명이다.

 ◇공동검역단 구성 놓고도 이견

농식품부는 공동검역단을 구성토록 한 조항에 대해서도 문제로 삼고 있다.

국내 법률로 수출국 현지조사를 하도록 규정한 것은 수출국의 주권을 침해할 소 지가 있는데다 수출국 동의 없이는 실행에 옮기기 어렵다는 설명이다.

입법부인 국회와 농식품부장관 소속 중앙가축방역협의회 동수로 추천해 공동검역단을 구성토록 한 부분도 행정부의 조사, 정책 집행 권한 등을 제약하는 것이라고 강조했다.

농식품부 관계자는 "공동검역단 운영은 실익이 없으므로 삭제하는 것이 바람직하다"며 "현재도 BSE 발생 때 하는 현지조사 결과를 전문가와 생산자ㆍ소비자  단체 로 구성된 중앙가축방역협의회에 보고해 의견을 받고서 그 내용을 언론에 공개하게 돼 있어 별도 규정으로 만들 필요가 없다"고 주장했다.

김 의원 측은 민주당 당론으로 채택된 만큼 정부의 반대에도 개정안을 처리하겠 다는 입장이지만, 새누리당 일각에서도 반대하고 있어 국회 통과를 놓고 진통이 예상된다.

김 의원실 관계자는 "BSE 발생 시 수입을 중단할 수 있는 규정이 명확하지 않아 구체화한 것이기 때문에 행정부 권한을 침해한 것이 아니다"라며 "미국이 WTO에 가 장 많이 제소된 국가임을 고려하면 WTO 패소 우려는 과장된 것"이라고 지적했다.

새누리당 홍문표 의원실 관계자는 "BSE 발생 때 수입 중단이 아닌 검역 중단을 검토한 여당으로서는 WTO에 어긋날 수 있는 즉각적인 수입 중단 주장에 동의하기 어렵다"며 "국민감정만으로 처리할 수 없으므로 신중하게 검토하겠다"라고 말했다.
