Court fines teacher for hitting student on the hands

A Seoul court ordered a high school teacher to pay damages for hitting a student on the hands, giving her bruises and inflammations, officials said Friday.

   The Seoul Northern District Court ordered the 52-year-old female teacher, identified only by her surname, No, to pay her former student 2.54 million won ($2,280) in compensation and medical expenses, court officials said.

The student, identified only by her surname of Jo, had requested 25.47 million won in damages after No repeatedly beat her on the hands for frequent absences, tardiness and for not doing her homework properly. She was beaten about 40 times with a wooden cane in November 2008.

   "Corporal punishment is not allowed unless it is unavoidable for educational purposes," the court said. "It is illegal to use physical punishment for repeatedly being late or absent or for not completing assignments properly."

   However, the teacher's responsibility was limited to 90 percent, considering the disciplinary nature of the punishment and the extent of damage caused to the student, it added.

법원, '손바닥 체벌' 교사에 배상 책임

"교육상 필요해도 지각·결석 체벌은 위법"

    (서울=연합뉴스) 김동호 기자 = 지각과 결석을 반복하고 학습태도가 좋지 않다 며 제자의 손바닥을 수십차례 회초리로 때린 교사에게 손해배상 책임을 묻는 판결이 나왔다.

    서울북부지법 민사7단독 정경근 판사는 조모(20·여)씨가 고등학교 교사 노모(5 2·여)씨를 상대로 낸 손해배상 청구소송에서 치료비 154만원과 위자료로 모두 254 만원을 지급하라며 원고 일부 승소로 판결했다고 18일 밝혔다.

    재판부는 "교육상 불가피한 경우가 아니면 체벌이 허용되지 않는데, 지각과 결 석을 반복하고 과제물을 제대로 이행하지 않았다는 이유로 체벌하는 것은 위법하다"

고 밝혔다.

    이어 "제자를 훈계하려고 체벌이 이뤄졌다는 점과 피해의 정도를 감안해 피고의 책임을 90%로 제한한다"고 덧붙였다.

    서울의 한 고교 교사로 재직 중이던 노씨는 2008년 11월 제자인 조씨가 결석과 지각을 자주하고 숙제를 제대로 해오지 않는다며 나무회초리로 조씨의 손바닥을 40 여회 때리는 등의 체벌을 가했다.

    조씨는 이 체벌로 양손에 약 3주간 치료를 요하는 타박상, 염증 등 상처를 입었 다며 2천547만원의 손해배상을 청구하는 소송을 냈다.
