Former pastor given 9 years for underage sex

A former pastor has been sentenced to nine years in prison for having sex with underage members of his congregation, the Seoul High Court said Sunday.

The 65-year-old man, surnamed Kang, had been indicted on charges of having sex with his victims, including a then 11-year-old girl, and sexually molesting three others at his church in 2006.

He was also found to have taken photos of them in sexual poses and beaten and threatened the victims when they did not answer his phone calls.

“The defendant assaulted five teenagers by coercing them with his religious authority and satisfied his sexual desire while watching the images that he took. He left serious, untreatable scars on the young victims,” the court ruling said.

Upholding the ruling of an earlier trial, the court also ordered that personal information about Kang be made available online for 10 years, that he undergo 80 hours of counseling and treatment, and ordered him to wear a traceable electronic anklet for six years.

During the first trial, Kang denied all allegations, saying the victims had sex with him of their own free will. However, the court said that it ruled him guilty of the charges, considering that much of the testimonies of the victims was consistent.

(서울=연합뉴스) 이세원 기자 = 서울고법 형사12부(최재형 부장판사)는 목사의 지위를 이용해 미성년 신도와 성행위를 한 혐의(성폭력 범죄의 처벌 및 피해자 보호 등에 관한 법률 위반)로 기소된 강모(65)씨에게 징역 9년을 선고했다고 23일 밝혔다.

또 신상정보공개 10년과 성폭력 치료프로그램 이수 80시간, 위치추적 전자장치(전자발찌) 부착 6년, 접근금지 6년을 명했다.

재판부는 "교회 목사로서 종교적 권위 등으로 피해자들을 사실상 반항하기 어렵게 해 5명의 어린 피해자를 상대로 범행했고, 범행 장면의 일부를 촬영한 영상을 보며 성욕을 충족하는 등 당사자에게 치유하기 어려운 심각한 고통을 준 것으로 보이는 점을 고려하면 1심의 형(징역 9년)이 무겁거나 가볍지 않다"고 밝혔다.

재판부는 특정 범죄자에 대한 위치추적 전자장치 부착 등에 관한 법률이 개정돼 13세 미만 아동에 대한 범죄는 부착기간을 하한의 2배로 해야 하는데 1심이 이를 간과했다며 부착기간을 1년 늘렸다.

경기도의 한 교회 목사로 근무하던 강씨는 2006년 말 교회 예배실에서 종교적 권위를 내세워 당시 11세인 A양에게 자과 성행위를 하도록 하는 등 작년 6월까지 위력(威力)을 이용해 미성년 신도 2명과 13차례에 걸쳐 성관계하고, 10대 남녀 신도를 3차례 성추행한 혐의 등으로 기소됐다.

그는 범행 장면을 촬영한 사진을 보관해 두고 보면서 성욕을 채웠고 전화를 받지 않는다는 이유로 피해자를 마구 폭행하거나 `잡히면 죽는다'는 등의 협박성 문자메시지를 반복해 보낸 것으로 확인됐다.

1심 재판에서 강씨는 `위력을 사용하지 않았고 피해자의 자유의사에 따라 성관계했다'고 주장했으나, 법원은 `해당 청소년이 범행과정과 전후 정황에 대해 비교적 한결같이 말한 점 등을 고려하면 이들의 진술이 믿을만하다'며 공소사실을 모두 유죄로 인정했다.
