The mother of one of three former medical students imprisoned for sexually harassing a female schoolmate received a jail term herself Wednesday for defaming the victim.

The three, who were expelled from medical school at the prestigious Korea University, were convicted of repeatedly groping a long-time female friend while she was in a deep sleep after drinking alcohol during a trip they took in May of last year. The male students also took pictures of their actions.

The Seoul Central District Court handed down a one-year prison term for the 52-year-old mother, identified only by her surname of Seo, for fabricating documents that claimed the female student has a personality disorder. Seo also circulated the documents to other medical students.

Her son, identified only by his surname of Bae, had an extra year added to his imprisonment on the same charge.

"The two inflicted irrevocable secondary damage to the victim by spreading fabricated information," Judge Lee Sung-ho said in the ruling. "Neither of them have shown remorse for their crime," the judge added, explaining the reason for handing down the prison terms.

성추행당한 여대생, 명예까지 짓밟혀

성추행 사건으로 실형이 확정된 고려대 의대생 배모(26)씨의 모친 서모(52)씨가 피해 여학생의 명예를 훼손한 혐의가 인정돼 법정 구속됐다.

서울중앙지법 형사12단독 이성호 판사는 22일 피해 여학생이 인격장애적 성향이라는 허위 사실이 담긴 문서를 꾸며 동료 의대생들에게 배포한 혐의(명예훼손)로 기소된 배씨와 서씨에게 각각 징역 1년을 선고했다.

불구속 상태로 재판을 받아온 서씨는 바로 수감됐고, 배씨는 이 형이 그대로 확정되면 성추행 사건 재판에서 확정된 징역 1년6월에 더해 최대 2년6월을 복역해야 한다.

재판부는 "피고인들은 성추행 사건과 관련해 정당한 방어권 행사를 위한 것이었다고 주장하지만, 구체적 근거가 없는 허위사실을 적시해 피해자에게 회복할 수 없는 2차 피해를 줘 사실상 방어가 아닌 공격이 돼버렸다"고 판단했다.

또 "서씨의 경우 아들의 구명을 위해 저지른 것으로 정서적•감정적으로 납득하고 동정할 여지는 있지만, 그 방법은 이성과 논리가 필요했는데 그러지 못했다"고 강조했다.

재판부는 "범행으로 피해자가 의사 생활이 쉽지 않게 돼 강제추행보다 더 큰 피 해를 입게 된 것으로 미루어 짐작할 수 있고, 배씨와 서씨가 범행을 부인하고 반성하지 않는 등 죄질이 매우 불량하다"고 양형 이유를 밝혔다

앞서 배씨는 지난해 5월 경기도 가평으로 함께 여행을 갔다가 술에 취해 정신을 잃은 동기 여학생을 다른 의대생 2명과 함께 성추행한 혐의로 구속기소돼 대법원에서 징역 1년6월의 확정판결을 받았다.

배씨와 서씨는 수사단계에서 구속을 피하는데 유리한 자료를 만들어 법원에 제출하려고 "피해 여학생의 인격장애적 성향 때문에 사건 내용이 부풀려졌다"는 허위 내용을 담은 `사실확인서'를 꾸며 같은 학교 의대생들에게 돌린 혐의로 성추행 사건 의 항소심 재판이 진행 중이던 작년 12월 추가 기소됐다.
